Kacific Acceptable Use Policy

Kacific Acceptable Use Policy

1. Introduction
This acceptable use policy (the “Policy”) defines acceptable practices for the use of internet broadband services by
customers of Kacific and by users that have gained access to such services through these customers. The Policy is
incorporated by reference into any agreement for service entered into between Kacific and its customers.
Kacific reserves the right to update this Policy from time to time and will maintain the latest copy of the Policy on its
website www.kacific.com .

The Policy is designed to help protect the Kacific Network, the Service, Users, and the Internet community as a whole from
improper and illegal activity over the Internet and to improve the quality of the Service and other offerings.

2. Terminology
For purposes of the Policy, the following are defined terms:
“Agreement” means an agreement for service entered into between Kacific and a Customer.

“Customer” means a customer who has executed an Agreement with Kacific and may also be referred to herein as “you”.
“Kacific” means Kacific Broadband Satellites International Ltd or any of its affiliates and may also be referred to herein
as “we” or “us”.

“Kacific Network” shall mean Kacific’s satellite internet service and related equipment, systems, facilities, and other
services used in the transmission of the Service. “Service” shall mean the internet service provided by Kacific to Customer
under an Agreement.

“Users” shall mean users who have access gained access to the Service through a Customer.

3. Agreement to Policy
By using the Service, you acknowledge and agree that you and your Users are responsible for compliance with the Policy.
You are responsible for violations of the Policy by any User that accesses the Service (whether or not that User is the
named User in your contract with the end user of the Service). You also agree to fully cooperate with Kacific in any
investigation regarding violation of the Policy by a User.

All references in the Agreement to capacity shall be deemed to be references to the maximum information rate (“MIR”) at which information can be transmitted over the applicable network or system, unless stated otherwise.

4. Kacific’s Rights under the Policy
4.1 Suspension or Termination of Service. We reserve the right to suspend or terminate your access to the Service if
any User engages in conduct that violates a provision of the Policy, and such conduct is not corrected within the
time frame specified in the written notice. Before doing so, we will provide you with written notice, if it is practically
feasible to do so. In severe cases, i.e. where the operations of the Kacific Network or other Kacific customers are
threatened, we reserve the right to suspend or terminate your access to the Service without notification.
Kacific does not make any promise, nor have any obligation, to monitor the activity of individual Users and will have
no liability to any party, including you, for any violation of the Policy by Users.

4.2 Cooperation with Law Enforcement. Kacific will cooperate with appropriate law enforcement agencies involved in
investigating claims of illegal or inappropriate activity. We further reserve the right to disclose User information to
the extent authorised by law. By using and accepting the Service, you consent to our disclosure to any law
enforcement agency, without the need for a subpoena, of your identity as the User of record (including basic
contact information), and the identity of any other User who has gained access to the Service through you about
whom Kacific is contacted by the law enforcement agency.

5. Prohibited Uses
Uses of the Service that will constitute violations of the Policy include:

5.1 Illegal Activity. The Service shall not be used for any unlawful activities and shall, in all cases, be used in compliance
with applicable law. Use of the Service or the Kacific Network for transmission, distribution, retrieval, or storage of
any information, data, or other material in violation of any applicable law or regulation (including, where applicable,
any tariff or treaty) is prohibited. This includes, without limitation, the use or transmission of any data or material
protected by copyright, trademark, trade secret, patent, or other intellectual property right without proper
authorisation, and the transmission of any material that constitutes an illegal threat, violates export control laws,
or is obscene, defamatory or otherwise unlawful.

5.2 Unauthorised Access/Interference. A User may not:
– attempt to gain unauthorised access to or attempt to interfere with or compromise the normal functioning,
operation, or security of any portion of the Kacific Network or any other satellite system;
– use the Service to engage in any activities that may interfere with the ability of others to access or use the
Service or the Internet;
– use the Service to monitor any data, information, or communications on any network or system without
authorisation; or
– attempt to gain unauthorised access to the user accounts or passwords of other Users.
The use of any transmission equipment other than that which is expressly approved by Kacific is strictly prohibited.

5.3 Unsolicited Commercial Email/Spamming/Mailbombing. A User may not use the Service to transmit unsolicited
commercial email messages or deliberately send excessively large attachments to one recipient. Spamming or
“mailbombing” is prohibited. Likewise, a User may not use the Service to collect responses from mass unsolicited
email messages. Kacific may, in its sole discretion, rely upon information obtained from anti-spamming
organisations as evidence that a User is an active “spam operator” for purposes of taking remedial action under the
Policy.

5.4 Spoofing/Fraud. Users are prohibited from injecting false data into the Internet, for instance, in the form of bad
routing information (including, but not limited to, the announcing of networks owned by someone else or reserved
by the Internet Corporation for Assigned Names and Numbers) or incorrect DNS information. A User may not
attempt to send email messages or transmit any electronic communications using a name or address of someone
other than the User for purposes of deception. Any attempt to impersonate someone else by altering a source IP
address information or by using forged headers or other identifying information is prohibited. Any attempt to
fraudulently conceal, forge or otherwise falsify a User’s identity in connection with the use of the Service is
prohibited.

5.5 Inbound Complaints. Kacific receives complaints directly from Internet users and other parties. Kacific shall not be
required to determine the validity of complaints received, or of information obtained from anti-spamming
organisations, but shall notify the Customer of the complaint and where possible provide a reasonable period of
time (depending on the nature of the complaint) for the Customer to resolve the complaint before taking action
under the Policy.

5.6 Other Prohibited Activities. The following activities will also constitute violations of the Policy and may result in
suspension or termination of the User’s access to the Service.

5.6.1 Intentionally transmitting files containing a computer virus or corrupted data.

5.6.2 Attempting to circumvent or alter the processes or procedures to measure time, bandwidth utilisation,
or other methods to document the use of the Service.

5.6.3 Advertising, transmitting, or otherwise making available any software, programme, product, or Service
that is designed to violate the Policy, which includes the facilitation of the means to deliver unsolicited
commercial email.

5.6.4 Any activity that disrupts, degrades, harms, or threatens to harm the Kacific Network or the Service.

5.6.5 Any use of another party’s electronic mail server to relay email without express permission from such
other party.

5.6.6 Any other inappropriate activity or abuse of the Service (as determined by us in our sole discretion),
whether or not explicitly listed in the Policy.

5.6.7 Any use of the Service for military purposes without our prior consent.

5.6.8 Any use of the Service that includes transmitting radio waves from Japan and its territorial waters and
airspace.

6. Fair Usage Policy
Sections 6.1, 6.2, 6.3, 6.4 and 6.5 below do not apply to Users of a Community WIFI service.
All Users shall be able to access our services and get the best possible experience. To ensure the provision of a high
quality of service, a Fair Usage Policy (“FUP”) applies to the use of the Service, where the User’s usage can affect that of
other Users. We have developed this FUP by reference to average User profiles and estimated usage by the Users of the
Service.

6.1 Bandwidth allocated to Users is reviewed as required, but at any time, there is only a fixed amount of bandwidth
available within the Kacific Network. This FUP aims to ensure that the unreasonable usage of a few does not
compromise the experience of the vast majority of Users.

6.2 We reserve the right to modify (through speed and other variables) the behaviour of Users that frequently use
significantly more data than the majority of the other Users and/or use their Internet service in a way that negatively
affects the experience of other Users. If Users are found to be amongst the 10% heaviest Users, and their usage
negatively impacts the Kacific Network and other Users, we may attempt to communicate with the Customer and
request that the Customer (and/or its Users) modify their usage, may suggest a more suitable solution for all parties
involved, or may exercise our rights outlined in this FUP.

6.3 We may issue a warning to the Customer to suspend its Service, where in our reasonable opinion the User’s use of
the Service is excessive and/or unreasonable because it materially exceeds estimated usage patterns over any
month.

6.4 Where reasonable and practical, we will provide the Customer with 7 days’ notice before the suspension,
restriction, or termination of its Service.

6.5 If, after we have requested that the Customer stop or alter the usage to come within our FUP, the excessive or
unreasonable use continues, we may without further notice apply charges to the Customer’s account for the
excessive and/or unreasonable element of usage, suspend, modify or restrict the Customer’s use of the Service, or
withdraw the Customer’s access to the Service. If we terminate the Customer’s Service under a fixed contract term,
an early termination fee may apply.
The Kacific Gigstarter plans are subject to a prioritization policy as follows:
Residential Household Plan:
The plan provides a maximum download speed of 3Mbps and a maximum upload speed of 3Mbps. The plan does
not throttle these maximum possible speeds but provides two tiers of access priority to bandwidth resources. The
plan provides 30Gbytes of first priority download data every month and unlimited second priority download data,
subject to this FUP. The plan providesfirst priority upload data at all times,subject to this FUP.

Residential Household Plan:
The plan provides a maximum download speed of 15Mbps and a maximum upload speed of 10Mbps. The plan
does not throttle these maximum possible speeds but providestwo tiers of access priority to bandwidth resources.
The plan provides 35Gbytes of first priority download data every month and unlimited second priority download
data,subject to this FUP. The plan providesfirst priority upload data at all times,subject to this FUP.

Enterprise Plan (Internet usage for up to 4 users):
The plan provides a maximum download speed of 30Mbps and a maximum upload speed of 10Mbps. The plan
does not throttle these maximum possible speeds but providestwo tiers of access priority to bandwidth resources.
The plan provides 50Gbytes of first priority download data every month and unlimited second priority download
data,subject to this FUP. The plan providesfirst priority upload data at all times,subject to this FUP.

Enterprise Plan (Internet usage for up to 5-6 users):
The plan provides a maximum download speed of 40Mbps and a maximum upload speed of 10Mbps. The plan does not throttle these maximum possible speeds but provides two tiers of access priority to bandwidth resources. The plan provides 85Gbytes of first priority download data every month and unlimited second priority download data, subject to this FUP. The plan provides first priority upload data at all times, subject to this FUP.

Enterprise Plan (Internet usage for up to 7 users):
The plan provides a maximum download speed of 50Mbps and a maximum upload speed of 10Mbps. The plan
does not throttle these maximum possible speeds but providestwo tiers of access priority to bandwidth resources.
The plan provides 185Gbytes of first priority download data every month and unlimited second priority download
data,subject to this FUP. The plan providesfirst priority upload data at all times,subject to this FUP.

Enterprise Plan (Internet usage for up to 10 users):
The plan provides a maximum download speed of 60Mbps and a maximum upload speed of 20Mbps. The plan
does not throttle these maximum possible speeds but providestwo tiers of access priority to bandwidth resources.
The plan provides 295Gbytes of first priority download data every month and unlimited second priority download
data,subject to this FUP. The plan providesfirst priority upload data at all times,subject to this FUP.

Enterprise Plan (Internet usage for up to 25 users):
The plan provides a maximum download speed of 70Mbps and a maximum upload speed of 20Mbps. The plan
does not throttle these maximum possible speeds but providestwo tiers of access priority to bandwidth resources.
The plan provides 735Gbytes of first priority download data every month and unlimited second priority download
data,subject to this FUP. The plan providesfirst priority upload data at all times,subject to this FUP.

Enterprise Plan (Internet usage for up to 60 users):
The plan provides a maximum download speed of 100Mbps and a maximum upload speed of 20Mbps. The plan
does not throttle these maximum possible speeds but providestwo tiers of access priority to bandwidth resources.
The plan provides 1,425Gbytes of first priority download data every month and unlimited second priority download
data,subject to this FUP. The plan providesfirst priority upload data at all times,subject to this FUP.

Enterprise Plan (Internet usage for up to 180 users):
The plan provides a maximum download speed of 150Mbps and a maximum upload speed of 30Mbps. The plan
does not throttle these maximum possible speeds but providestwo tiers of access priority to bandwidth resources.
The plan provides 3,188Gbytes of first priority download data every month and unlimited second priority download
data,subject to this FUP. The plan providesfirst priority upload data at all times,subject to this FUP.
The following prioritization policies apply only to Customers / Users whose service was activated before the
following dates:

The plan provides a maximum download speed of 20Mbps and a maximum upload speed of 5Mbps. The plan does
not throttle these maximum possible speeds but provides two tiers of priority access to bandwidth resources. The
plan provides 49Gbytes of first priority download data every month and unlimited second priority download data,
subject to this FUP. The plan provides first priority upload data at all times, subject to this FUP.

Enterprise Plan (Internet usage for up to 4 users):
The plan provides a maximum download speed of 35Mbps and a maximum upload speed of 5Mbps. The plan does
not throttle these maximum possible speeds but provides two tiers of access priority to bandwidth resources. The
plan provides 70Gbytes of first priority download data every month and unlimited second priority download data,
subject to this FUP. The plan provides first priority upload data at all times, subject to this FUP.

6.6 Customers, resellers, and Users acknowledge that Kacific does not, and cannot, in any way supervise, edit, or control
the content and form of any information or data accessed through the Internet. Kacific shall not be held responsible
in any way for any content or information accessed via the Kacific Network.
Furthermore, Kacific disclaims all or any responsibility or liability for any material on the Internet that you or any
User may find offensive, upsetting, defamatory, and personally offensive and in any way unsuitable for minors.

6.7 Some internet sites may have embedded within them the ability to programme devices such as the User’s PC, WiFi
device, tablet, or mobile phone, without the Users’ knowledge or direction. Users are liable for any charges arising
from such actions by third parties, and neither we nor Kacific accepts any liability for any charges and/or damages
the Users may incur by using the Internet.

6.8 Users are not permitted to operate servers from the Service and/or to on-sell the Service without our written
approval.

6.9 Users are not permitted to send spam or bulk mail using the Service and we reserve the right to charge you any
costs that are required to rectify the result of such activity.

6.10 We reserve the right to manage the network to improve overall performance and customer experience. In
particular, we may act such that the usage of popular services such as standard web browsing, and email is not
adversely affected by other applications such as peer to peer or file sharing.

6.11 The Users’ use of our Service is subject to traffic prioritisation by Kacific, where the allocation of bandwidth
resources is necessary to minimise congestion.

6.12 Kacific uses Quality of Service (QoS) configurations within the Kacific Network and at its sole discretion to prioritise
specific types of internet traffic over others to enhance the overall User experience.
These maximum speeds are not guaranteed, and the probability of obtaining such speeds depends on the level of
priority of each User and instantaneous traffic loading factors.

6.13 Kacific reserves the right, at any time and at its sole discretion and without any prior notice, to change, modify,
edit, replace, or withdraw any or all of this FUP.

6.14 This FUP does not replace any of the terms, conditions, or obligations the Agreement. In the event of any
inconsistency (in the reasonable determination of Kacific), the provisions of the Agreement shall prevail.

7. Complaints and Contact Information
Any complaints or notifications regarding prohibited use or other abuse of the Service or Kacific Network, including
violations of the Policy, should be sent to Kacific by email at complaints@kacific.com. Please include all applicable
information that will assist Kacific in investigating the complaint, including all applicable headers of forwarded messages.
Kacific reserves the right to, at any time and at its sole discretion and without any prior notice, change, modify, edit,
replace, or withdraw any or all of this Acceptable Use Policy.

email messages. Kacific may, in its sole discretion, rely upon information obtained from anti-spamming
organisations as evidence that a User is an active “spam operator” for purposes of taking remedial action under
the Policy.

5.4 Spoofing/Fraud. Users are prohibited from injecting false data into the Internet, for instance, in the form of bad
routing information (including, but not limited to, the announcing of networks owned by someone else or
reserved by the Internet Corporation for Assigned Names and Numbers) or incorrect DNS information. A User
may not attempt to send email messages or transmit any electronic communications using a name or address of
someone other than the User for purposes of deception. Any attempt to impersonate someone else by altering a
source IP address information or by using forged headers or other identifying information is prohibited. Any
attempt to fraudulently conceal, forge or otherwise falsify a User’s identity in connection with the use of the
Service is prohibited.

5.5 Inbound Complaints. Kacific receives complaints directly from Internet users and other parties. Kacific shall not
be required to determine the validity of complaints received, or of information obtained from anti-spamming
organisations, but shall notify the Customer of the complaint and where possible provide a reasonable period of
time (depending on the nature of the complaint) for the Customer to resolve the complaint before taking action
under the Policy.

5.6 Other Prohibited Activities. The following activities will also constitute violations of the Policy and may result in
suspension or termination of the User’s access to the Service.

5.6.1 Intentionally transmitting files containing a computer virus or corrupted data.

5.6.2 Attempting to circumvent or alter the processes or procedures to measure time, bandwidth utilisation,
or other methods to document the use of the Service.

5.6.3 Advertising, transmitting, or otherwise making available any software, programme, product, or Service
that is designed to violate the Policy, which includes the facilitation of the means to deliver unsolicited
commercial email.

5.6.4 Any activity that disrupts, degrades, harms, or threatens to harm the Kacific Network or the Service.

5.6.5 Any use of another party’s electronic mail server to relay email without express permission from such
other party.

5.6.6 Any other inappropriate activity or abuse of the Service (as determined by us in our sole discretion),
whether or not explicitly listed in the Policy.

5.6.7 Any use of the Service for military purposes without our prior consent.

5.6.8 Any use of the Service that includes transmitting radio waves from Japan and its territorial waters and
airspace.

6. Fair Usage Policy
Sections 6.1, 6.2, 6.3, 6.4 and 6.5 below do not apply to Users of a Community WIFI service.
All Users shall be able to access our services and get the best possible experience. To ensure the provision of a high
quality of service, a Fair Usage Policy (“FUP”) applies to the use of the Service, where the User’s usage can affect that of
other Users. We have developed this FUP by reference to average User profiles and estimated usage by the Users of the
Service.

6.1 Bandwidth allocated to Users is reviewed as required, but at any time, there is only a fixed amount of bandwidth
available within the Kacific Network. This FUP aims to ensure that the unreasonable usage of a few does not
compromise the experience of the vast majority of Users.

6.2 We reserve the right to modify (through speed and other variables) the behaviour of Users that frequently use
significantly more data than the majority of the other Users and/or use their Internet service in a way that
negatively affects the experience of other Users. If Users are found to be amongst the 10% heaviest Users, and
their usage negatively impacts the Kacific Network and other Users, we may attempt to communicate with the
Customer and request that the Customer (and/or its Users) modify their usage, may suggest a more suitable
solution for all parties involved, or may exercise our rights outlined in this FUP.

6.3 We may issue a warning to the Customer to suspend its Service, where in our reasonable opinion the User’s use
of the Service is excessive and/or unreasonable because it materially exceeds estimated usage patterns over any
month.

6.4 Where reasonable and practical, we will provide the Customer with 7 days’ notice before the suspension,
restriction, or termination of its Service.

6.5 If, after we have requested that the Customer stop or alter the usage to come within our FUP, the excessive or
unreasonable use continues, we may without further notice apply charges to the Customer’s account for the
excessive and/or unreasonable element of usage, suspend, modify or restrict the Customer’s use of the Service,
or withdraw the Customer’s access to the Service. If we terminate the Customer’s Service under a fixed contract
term, an early termination fee may apply.
The Kacific Commsbox plan is subject to a prioritization policy as follows:
The plan provides a maximum download speed of 50Mbps and a maximum upload speed of 5Mbps. The plan
does not throttle these maximum possible speeds but provides two tiers of access priority to bandwidth
resources. The plan provides 185Gbytes of first priority download data every month and unlimited second
priority download data, subject to this FUP. The plan provides first priority upload data at all times, subject to
this FUP.

6.6 Customers, resellers, and Users acknowledge that Kacific does not, and cannot, in any way supervise, edit, or
control the content and form of any information or data accessed through the Internet. Kacific shall not be held
responsible in any way for any content or information accessed via the Kacific Network.
Furthermore, Kacific disclaims all or any responsibility or liability for any material on the Internet that you or any
User may find offensive, upsetting, defamatory, and personally offensive and in any way unsuitable for minors.

6.7 Some internet sites may have embedded within them the ability to programme devices such as the User’s PC,
WiFi device, tablet, or mobile phone, without the Users’ knowledge or direction. Users are liable for any charges
arising from such actions by third parties, and neither we nor Kacific accepts any liability for any charges and/or
damages the Users may incur by using the Internet.

6.8 Users are not permitted to operate servers from the Service and/or to on-sell the Service without our written
approval.

6.9 Users are not permitted to send spam or bulk mail using the Service and we reserve the right to charge you any
costs that are required to rectify the result of such activity.

6.10 We reserve the right to manage the network to improve overall performance and customer experience. In
particular, we may act such that the usage of popular services such as standard web browsing, and email is not
adversely affected by other applications such as peer to peer or file sharing.

6.11 The Users’ use of our Service is subject to traffic prioritisation by Kacific, where the allocation of bandwidth
resources is necessary to minimise congestion.

6.12 Kacific uses Quality of Service (QoS) configurations within the Kacific Network and at its sole discretion to
prioritise specific types of internet traffic over others to enhance the overall User experience.
These maximum speeds are not guaranteed, and the probability of obtaining such speeds depends on the level of
priority of each User and instantaneous traffic loading factors.

6.13 Kacific reserves the right, at any time and at its sole discretion and without any prior notice, to change, modify,
edit, replace, or withdraw any or all of this FUP.

6.14 This FUP does not replace any of the terms, conditions, or obligations of the Agreement. In the event of any
inconsistency (in the reasonable determination of Kacific), the provisions of the Agreement shall prevail.

7. Complaints and Contact Information
Any complaints or notifications regarding prohibited use or other abuse of the Service or Kacific Network, including
violations of the Policy, should be sent to Kacific by email at complaints@kacific.com. Please include all applicable
information that will assist Kacific in investigating the complaint, including all applicable headers of forwarded messages.
Kacific reserves the right to, at any time and at its sole discretion and without any prior notice, change, modify, edit,
replace, or withdraw any or all of this Acceptable Use Policy.

1. Introduction
This acceptable use policy (the “Policy”) defines acceptable practices for the use of internet broadband services by
customers of Kacific and by users that have gained access to such services through these customers. The Policy is
incorporated by reference into any agreement for service entered into between Kacific and its customers.
Kacific reserves the right to update this Policy from time to time and will maintain the latest copy of the Policy on its
website www.kacific.com .

The Policy is designed to help protect the Kacific Network, the Service, Users, and the Internet community as a whole from
improper and illegal activity over the Internet and to improve the quality of the Service and other offerings.

2. Terminology
For purposes of the Policy, the following are defined terms:
“Agreement” means an agreement for service entered into between Kacific and a Customer.

“Customer” means a customer who has executed an Agreement with Kacific and may also be referred to herein as “you”.
“Kacific” means Kacific Broadband Satellites International Ltd or any of its affiliates and may also be referred to herein
as “we” or “us”.

“Kacific Network” shall mean Kacific’s satellite internet service and related equipment, systems, facilities, and other
services used in the transmission of the Service. “Service” shall mean the internet service provided by Kacific to Customer
under an Agreement.

“Users” shall mean users who have access gained access to the Service through a Customer.

3. Agreement to Policy
By using the Service, you acknowledge and agree that you and your Users are responsible for compliance with the Policy.
You are responsible for violations of the Policy by any User that accesses the Service (whether or not that User is the
named User in your contract with the end user of the Service). You also agree to fully cooperate with Kacific in any
investigation regarding violation of the Policy by a User.

All references in the Agreement to capacity shall be deemed to be references to the maximum information rate (“MIR”)
at which information can be transmitted over the applicable network or system, unless stated otherwise.

4. Kacific’s Rights under the Policy
4.1 Suspension or Termination of Service. We reserve the right to suspend or terminate your access to the Service if
any User engages in conduct that violates a provision of the Policy, and such conduct is not corrected within the
time frame specified in the written notice. Before doing so, we will provide you with written notice, if it is practically
feasible to do so. In severe cases, i.e. where the operations of the Kacific Network or other Kacific customers are
threatened, we reserve the right to suspend or terminate your access to the Service without notification.
Kacific does not make any promise, nor have any obligation, to monitor the activity of individual Users and will have
no liability to any party, including you, for any violation of the Policy by Users.

4.2 Cooperation with Law Enforcement. Kacific will cooperate with appropriate law enforcement agencies involved in
investigating claims of illegal or inappropriate activity. We further reserve the right to disclose User information to
the extent authorised by law. By using and accepting the Service, you consent to our disclosure to any law
enforcement agency, without the need for a subpoena, of your identity as the User of record (including basic
contact information), and the identity of any other User who has gained access to the Service through you about
whom Kacific is contacted by the law enforcement agency.

5. Prohibited Uses
Uses of the Service that will constitute violations of the Policy include:

5.1 Illegal Activity. The Service shall not be used for any unlawful activities and shall, in all cases, be used in compliance
with applicable law. Use of the Service or the Kacific Network for transmission, distribution, retrieval, or storage of
any information, data, or other material in violation of any applicable law or regulation (including, where applicable,
any tariff or treaty) is prohibited. This includes, without limitation, the use or transmission of any data or material
protected by copyright, trademark, trade secret, patent, or other intellectual property right without proper
authorisation, and the transmission of any material that constitutes an illegal threat, violates export control laws,
or is obscene, defamatory or otherwise unlawful.

5.2 Unauthorised Access/Interference. A User may not:
– attempt to gain unauthorised access to or attempt to interfere with or compromise the normal functioning,
operation, or security of any portion of the Kacific Network or any other satellite system;
– use the Service to engage in any activities that may interfere with the ability of others to access or use the
Service or the Internet;
– use the Service to monitor any data, information, or communications on any network or system without
authorisation; or
– attempt to gain unauthorised access to the user accounts or passwords of other Users.
The use of any transmission equipment other than that which is expressly approved by Kacific is strictly prohibited.

5.3 Unsolicited Commercial Email/Spamming/Mailbombing. A User may not use the Service to transmit unsolicited
commercial email messages or deliberately send excessively large attachments to one recipient. Spamming or
“mailbombing” is prohibited. Likewise, a User may not use the Service to collect responses from mass unsolicited
email messages. Kacific may, in its sole discretion, rely upon information obtained from anti-spamming
organisations as evidence that a User is an active “spam operator” for purposes of taking remedial action under the
Policy.

Residential Household Plan:

ANY CONTENT OR SERVICES, UNINSTALL THE APP AND ERASE ALL COPIES OF THE

1. DEFINITIONS
1. In these Terms, unless the context otherwise requires, the following
expressions will have the following meanings:
“Agreement” refers to these Terms;
”Authorized Representatives” refers to any and all of Kacific, its
affiliates and their respective directors, officers, employees, agents and contractors;
“Content” refers to any and all human readable audio and/or visual
elements on the App, including any information, text, graphics, images, illustrations, photographs, animation, audio/visual works, designs,
logos, trade names, service marks, advertisements, promotional
material and other materials;
“Services” refers to all services provided by Kacific and/or its affiliates
via the App (including broadband services), the processing of orders
for the subscription of Services and the processing of orders for
upgrading of Services;
“you” or “your” refers to any person that accesses and/or uses the App
and makes any online transactions including any subscription to any
Services via the App and where any person is accessing the App on
behalf of an entity, also refers that entity;
References to “we”, “us”, “our” or “Kacific” shall refer to [Kacific
Broadband Satellite Limited (Registration No.
201317505N)] or the relevant Kacific entity that is providing the
Service to you (including its successors and assigns).

2. The headings used in these Terms are for convenient reference only
and do not affect interpretation.

3. Words indicating the singular include the plural and vice versa, and
words indicating a gender include every gender, unless the context
otherwise requires.

4. No adverse inference shall be drawn against the party responsible for
the preparation of these Terms.

2. CONDITIONS OF USE
1. This App is owned by Kacific and/or its licensors. Subject to your
compliance with these Terms, we grant you a revocable, personal, nonexclusive and non-transferable licence to use the App (“Licence”) and
the Licence will terminate automatically if you fail to abide by these
Terms.

2. You are only permitted to use the App, for the sole purpose of
performing the functions on the App and accessing Content and/or our
Services, subject to these Terms. No other right, licence or permission
is granted to you in relation to the App and your use of the App. If you
are using the App on behalf of another, you warrant and represent that
you have authority to do so and authority on their behalf to bind them
to these terms.

3. The Licence shall continue unless and until terminated in accordance
with these Terms.

4. Upon termination of the Licence, you must uninstall the App and erase
all copies of the App under your control or ownership and stored in
any medium.

5. You (a) must provide accurate and complete information to us when
such information is sought or required from you, confirm that all the
information which you have provided in connection with the App or
these Terms are current, true, accurate, not misleading, supportable
and complete and must inform us immediately of any change in the
information provided to us (otherwise you may not be able or allowed
to access Services or Content on the App); (b) must comply with all
notices, directions or instructions which we may issue; and (c) must
use this App (including all Content and Services available on this App)
for lawful purposes only. Without prejudice to the generality of the
aforesaid, you may not (1) rent, lease, lend, resell, distribute, provide,
sublicense or offer or otherwise transfer in any way whatsoever, the
App or any Content or Services to any third party whether for profit or
not, or enable others to do so, without Kacific’s permission in writing,
or (2) use, download, sync or copy the app other than as permitted by
these Terms. If changes relate to personal information, you may inform
us of the changes in accordance with our Privacy Policy accessible at
https://kacific.com/privacy/.

6. Your use of this App, including all orders for Services via this App, is
governed by this Agreement, Kacific’s Privacy Policy as stated on
[https://kacific.com/nz/privacy/], Kacific’s Acceptable Use Policy as
stated on https://kacific.com/kacific-acceptable-use-policies, and the
terms of any end user contract, as may be required by Kacific or its
authorised Distributors. Any conflict or inconsistency between any of
these terms shall be resolved in a manner most favourable to Kacific, to
the fullest extent permissible under applicable laws.

7. Orders for Services are subject to Kacific’s prices and applicable terms
and conditions of Kacific and its authorised distributors for the
Services. You are liable for all charges and payments for all services,
products, Content and Services procured or obtained through the App.

8. Without prejudice to the generality of these Terms, and to the fullest
extent permissible under applicable laws, Kacific may at its absolute
discretion, restrict your access to or use of, add to, modify, discontinue,
withdraw, terminate, remove, suspend or disable the App, features or
portions of the App, or any Content or Services or terminate the
Licence without notice or liability to you. For the avoidance of doubt,
all pricing and availability Services on the App are subject to change
and Kacific does not guarantee that such information will be error-free,
complete, accurate or reliable.

9. From time to time, we may run competitions, promotions and surveys
via the App, subject to additional terms and conditions. You
acknowledge that if you do not agree or comply with those additional
terms, including any additional terms of a third party, you may not be
able to participate in the competitions, promotions and surveys.

10. You acknowledge that your use of the App may require access to other
networks not owned or operated by us, including the internet and
third party cellular networks. You acknowledge that your access to the
App shall be subject to the availability and quality of such third party
networks and any applicable terms and conditions imposed by such
third parties in relation to their networks.

11. The App may also require access to your device’s camera and/or
microphone including for the purposes of updating your user profile
settings in our databases and Gigstarter mobile application. You
acknowledge that parts of the App will not function properly without
providing such access.

12. Schedule 1 applies if you use this App on any Apple device or device
running iOS.

3. DATA PROTECTION
1. This App collects, retains, uses and discloses personal information that
you have provided to us and device data for the purposes of allowing
the App to perform its functions, including so that we may process
your subscription of Services, for upgrading or downgrading of
Services and to provide you with information such as your data usage
history. Such personal information which you provide to us via this
App and device data will be used in accordance with our Privacy Policy
accessible at [“https://kacific.com/nz/privacy/”]. You confirm that you
have read and agree with our Privacy Policy set out on our website and
consent to our collection, retention, use and disclosure of your
personal information and device data for the purposes set out above.

2. You agree to keep your device and access to this App secure. You
acknowledge that any removal of software restrictions and limitations
imposed by the official operating system of your device may make your
device vulnerable to malware, viruses or malicious programs and/or
compromise your device’s security features, and may also affect the
proper functionality of this App.

3. You consent to receive communications from us electronically. You
agree that all agreements, notices, disclosures and other
communications which we provide to you electronically satisfy any
legal requirement that such communications be in writing.

4. To provide location-based and real-time information services or
functionalities via the App, we and/or our authorised Distributors may
collect, transmit and use your precise location and other personal real
time data, including your real-time geographic location. You agree to
the collection, transmission and use of your location data or other data
for the provision of the location based and real-time information
services or functionalities via the App.

5. The App may also use or incorporate location based or real-time
information application programming interfaces (APIs). You
understand and agree that the use of any such functions and the
information provided via such functions is at your sole risk, and that
any location or real-time data provided may not be accurate or errorfree.

4. YOUR ACCOUNT
1. You are responsible for the security of your account information,
including usernames and/or passwords used in relation to the App.
Please inform us immediately in the event of any compromise in the
security of your username and/or password. Until such notification is
received and confirmed by us and access is disabled at your request,
you shall be responsible for all consequences arising from any
unauthorized or fraudulent use of the App.

5. SUBSCRIPTION TO SERVICES
1. Orders for Services may be subject to acceptance by Kacific’s
distributors. Your order will also be subject to such terms and
conditions as may be imposed by Kacific’s distributors. To the fullest
extent permitted by law, we will not be liable in any way for Kacific’s
distributors’ provision of or failure to provide the Services.

6. INTELLECTUAL PROPERTY
1. This App (including all Content) is protected by applicable intellectual
property right laws. Unless expressly permitted by Kacific in writing,
you must not copy, distribute, publish, perform, modify, download,
transmit, transfer, sell, license, reproduce, translate, adapt, vary,
reverse engineer, disassemble, create derivative works from or based
upon, distribute, post, publicly display, frame, link, or in any other way
exploit the App or any Content, whether in whole or in part. Any rights
not expressly granted to you herein are reserved.

2. This App and all marks including ” Kacific”, the Kacific logo and all
other trademarks, tradenames, logos and service marks on this App
(the ” Kacific Marks”), copyright, database rights and other intellectual
property rights related to the App, belong to Kacific or its licensors.
You must not attempt to extract the source code of this App, or make
derivative versions of it. Any product, service or trade name other than
those owned by Kacific may, even if not so indicated, be the service
mark or trademark of a third party (“Third Party Marks”). Third Party
Marks used on this App are used with the permission of their owners
or licensors and all of their rights are reserved. Any unauthorised use
of the Kacific Marks or any Third Party Marks is strictly prohibited.

3. You agree and acknowledge that all intellectual property related to the
App will remain at all times the property of Kacific or its licensors. You
will not use or permit the use of any intellectual property related to the
App except for the purposes contemplated by the App.

4. Kacific retains all right, title, and interest in and to all improvements,
enhancements or modifications to or resulting from the App, Content,
and/or Services, including all intellectual property in, software used,
inventions, know-how, confidential information or other technology
developed or arising from the App, Content, and/or Services. Kacific is
entitled to use, analyse, profit from, disclose, publish, keep secret, or
otherwise exploit any information, suggestion or idea arising from or
during the course of providing you access to the App, Content, and/or
Services to improve, modify or enhance any of Kacific’s products or
services without compensating or crediting you or anyone, except that
Kacific will not disclose or publish your information unless in
accordance with its Privacy Policy and applicable law.

7. INDEMNITY
You agree to pay Kacific and any of its Authorized Representatives and
any third party distributors (“Kacific Protected Persons”) should any
third party make any claim against that Kacific Protected Person,
including all liabilities, demands, losses, damages or expenses
(“Liability”) relating to that third party claim (a) but only to the extent
the Liability relates to your access to and use of this App, any Content
and/or any Services and (b) excluding any Liability that arises from
Kacific’s breach of these Terms. Your obligation to pay shall survive
termination of this Agreement.

8. DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY
1. This App (including all Content and Services available via this App) is
provided on an “as is” and “as available” basis and you accept that your
access or use of the App are at your own risk. Kacific expressly
disclaims all warranties of any kind, whether express or implied,
including implied warranties of merchantability, reasonable care and
skill, accuracy, satisfactory quality, non-infringement and fitness for a
particular purpose or any implied warranty arising from statute,
course of dealing, course of performance, or usage of trade, to the
fullest extent permissible under applicable laws. Without prejudice or
limitation to the foregoing, Kacific makes no warranty as to the
sequence, accuracy, completeness, security, compatibility, timeliness,
reliability, quality, suitability, reliability, originality or noninfringement of any Content or Service obtained or provided in this
App and will not be responsible for the security of Content transmitted
to, from or through the App. Kacific does not warrant that the App and
any Services will be provided uninterrupted, be available at all times,
be free from errors or that any identified defect will be corrected;
further, no warranty is given that access to and use of this App and the
Services will be free of viruses, worms, Trojan Horses, or other
malicious destructive or corrupting code or program or other harmful
components or from hacking or other unauthorised intrusion or
disclosure of your information. Kacific shall not be responsible for any
interruption, disruption to or deterioration in the quality, reliability or
accuracy of any Services or any technical issue that may arise from or
in relation to any Services that you may have connected to any device.
If you have difficulties in accessing or using this App, we may, at our
absolute discretion, extend help and assistance to you as an act of
goodwill but we shall in no event be obliged to provide the same. The
provision of such help and assistance shall in no event be deemed an
acknowledgement and/or acceptance of any liability on our part. This
clause 8(1) applies to the fullest extent permissible under applicable
laws.

2. To the fullest extent permissible under applicable laws, Kacific will not
be liable for any delay or failure in performance resulting from matters
beyond our reasonable control, including acts of God, acts or omissions
of third parties (including any supplier delivering or providing any
facilities, equipment, services or infrastructure to us), requirements of
any Authority, national emergency, war, riots, strikes, industrial
disputes (whether or not involving our employees), accident, lightning,
fire, computer software or software malfunction, equipment failure,
electrical power failure, faults, interruption or disruption of our
network or the networks of other service providers or of your
equipment or the equipment of any third party.

3. Without prejudice to the foregoing, and to the fullest extent
permissible under applicable laws, in no event shall Kacific be liable for
any direct, indirect, incidental, special, punitive or consequential
damages, losses, costs or expenses including loss of revenue or profit
(collectively, “Losses”) whether based on warranty, contract, tort,
including negligence, strict liability under statute or otherwise, and
whether or not Kacific is advised of the possibility of such Losses
suffered or incurred by you by reason of or in connection with the use
of this App and/or Services.

4. Notwithstanding the above, if for any reason Kacific cannot rely on the
limitations of liability set out above and Kacific is deemed liable to you,
Kacific’s maximum liability in contract, tort (including negligence or
breach of statutory duty) or otherwise to you and anyone who uses
this App (except for death or personal injury to the extent required by
law) shall be, limited to US Dollars Five Thousand only (US$5000)].

9. GENERAL TERMS
1. Kacific’s decision on all matters relating to this App (including all
Content and Services available on this App) will be final and
conclusive. In the absence of fraud or manifest error, Kacific’s records
of all matters relating to this App (including all Content and Services
available on this App) are conclusive evidence of the accuracy,
completeness and truth of such matters. This right does not extend to
the interpretation of, or the determination of either party’s compliance
with, this Agreement.

2. No delay or failure by Kacific to take any action or to enforce or
exercise any of its rights in this Agreement will operate as a waiver of
such rights by Kacific, nor will such failure or delay in any way
prejudice or affect Kacific’s rights at any time thereafter to act strictly
in accordance with Kacific’s rights in this Agreement.

3. This Agreement and any rights and obligations under it may not be
assigned or transferred by you, but may be assigned, novated or
transferred by Kacific without restriction.

4. Without prejudice to Clause 3.3 above, notices by us to you may also be
sent by post, fax or email to your contact details in our records.

5. We reserve the right to amend this Agreement from time to time,
subject to applicable laws. We will give you notice of such changes.
Where practicable to do so, we will give you reasonable advance notice
of such changes. Any notice under this clause can take the form of
postings on our website or such other forms as we deem appropriate.
You agree that the display of the revised Terms on our website will
constitute notice of the changes and your continued use of this App,
any Content or Services will constitute acceptance of the changes to
this Agreement.

6. Unless otherwise provided in this Agreement, this Agreement
constitutes the entire agreement between you and Kacific and
supersedes all prior agreements, understandings, promises,
conditions, representations and communications, oral or written,
whether issued by you or Kacific, with respect to the subject matter of
the Agreement and the transactions contemplated by it.

7. If any provision of this Agreement is held to be unenforceable, invalid
or illegal (whether in whole or in part), such provision shall to the
extent permissible be deemed modified or severed from this
Agreement, but only to the extent of such unenforceability, invalidity
or illegality and the remaining provisions shall not be affected.

8. Except for Clause 7, a person (including any user) who is not a party to
this Agreement has no right to enforce any of these Terms and
Conditions under the Contracts (Rights of Third Parties) Act (Cap 53B).

9. This Agreement shall be governed by Singapore law and all parties
agree to submit to the exclusive jurisdiction of the Singapore courts.
Any processes or judgment may be given to you in the same way as
notices under this Agreement., unless applicable law requires
otherwise.

10. [Where you are using the app for business purposes, the Consumer
Guarantees Act 1993 and sections 9, 12A, 13 and 14(1) of the Fair
Trading Act 1986 do not apply in connection with these Terms and
Conditions, to the fullest extent permitted by applicable law. The
parties acknowledge and agree that where they are contracting for
business purposes, this clause 9(10) is fair and reasonable in the
context of their commercial relationship.]

Schedule 1
1. You agree that these Terms are concluded between you and we only and not
with Apple Inc (“Apple”) and we, not Apple, are solely responsible for the App
and the Content/Services.

2. You agree that Apple has no obligation whatsoever to furnish any maintenance
and support services with respect to the App.

3. In the event of any failure of the App to conform to any applicable warranty, you
may notify Apple, and Apple will refund the purchase price of the App to you.
You agree that to the maximum extent permitted by applicable law, Apple will
have no other warranty obligation whatsoever with respect to the App, and no
responsibility for any other claims, losses, liabilities, damages, costs or expenses
attributable to any failure to conform to any warranty.

4. You agree that, except for paragraph 3 above, Apple is not responsible for
addressing any claims relating to the App or your possession or use of the App,
including, but not limited to: (i) product liability claims; (ii) any claim that the
App fails to conform to any applicable legal or regulatory requirement; and (iii)
claims arising under consumer protection or similar legislation.

5. You agree that in the event of any third party claim that the App or the user’s
possession and use of that App infringes that third party’s intellectual property
rights, Apple is not responsible for the investigation, defense, settlement and
discharge of any such intellectual property infringement claim.

6. You represent and warrant that (i) you are not located in a country that is
subject to a U.S. Government embargo, or that has been designated by the U.S.
Government as a ‘terrorist supporting” country; and (ii) you are not listed on any
U.S. Government list of prohibited or restricted parties.

9. You agree that Apple, and Apple’s subsidiaries, are third party beneficiaries of
these Terms and that, upon your acceptance of these terms, Apple will have the
right (and will be deemed to have accepted the right) to enforce these Terms
against you as a third party beneficiary.

1. Pendahuluan

Kebijakan penggunaan yang dapat diterima ini (“Kebijakan”) menetapkan praktik-praktik yang dapat diterima untuk penggunaan layanan Kacific oleh pelanggan Kacific dan oleh pengguna yang telah memperoleh akses ke layanan tersebut melalui pelanggan ini. Kebijakan ini dimasukkan melalui penyebutan ke dalam Perjanjian Kerangka Kerja (“Perjanjian”) dan setiap Lampiran yang dibuat sesuai dengan Perjanjian Kerangka Kerja, antara Kacific dan masing-masing pelanggannya. 2. Terminologi

Untuk tujuan Kebijakan ini, istilah-istilah berikut ini didefinisikan sebagai berikut:

“Kacific” berarti Kacific Broadband Satellites International Ltd atau setiap perusahaan afiliasinya dan juga dapat disebut di sini sebagai “kami”.

“Pelanggan” berarti pelanggan Kacific yang telah menandatangani Perjanjian dengan kami dan dapat disebut di sini sebagai “Anda”.

“Pengguna” berarti pelanggan Anda yang mengakses Layanan.

“Layanan” berarti layanan internet yang disediakan oleh Kacific kepada Pelanggan.

“Kacific Network” berarti layanan internet satelit Kacific dan peralatan terkait, sistem, fasilitas, dan layanan lain yang digunakan dalam pemberian Layanan.

3. Persetujuan terhadap Kebijakan

Dengan menggunakan Layanan, Anda mengakui dan setuju bahwa Anda dan Pengguna Anda bertanggung jawab untuk mematuhi Kebijakan. Anda bertanggung jawab atas pelanggaran Kebijakan oleh Pengguna yang mengakses Layanan melalui akun Anda. Anda juga setuju untuk bekerja sama sepenuhnya dengan Kacific dalam setiap penyelidikan apa pun yang terkait dengan pelanggaran Kebijakan oleh Pengguna.

Semua referensi dalam Perjanjian mengenai kapasitas akan dianggap sebagai referensi untuk kecepatan informasi maksimum (“MIR”) di mana informasi dapat ditransmisikan melalui jaringan atau sistem yang berlaku, kecuali jika dinyatakan sebaliknya.

4. Hak Kacific berdasarkan Kebijakan

4.1 Penangguhan atau Pengakhiran Layanan. Kacific berhak menangguhkan atau mengakhiri akses Pengguna ke Layanan, dengan memberikan pemberitahuan tertulis kepada Pelanggan sejauh memungkinkan, jika Pengguna terlibat dalam tindakan yang melanggar suatu ketentuan dari Kebijakan ini, dan tindakan tersebut tidak diperbaiki dalam jangka waktu yang ditentukan dalam pemberitahuan tertulis. Dalam kasus yang serius, yaitu apabila operasi Jaringan Kacific atau pelanggan Kacific lainnya terancam, Kacific berhak untuk menangguhkan atau mengakhiri akses Pengguna ke Layanan tanpa pemberitahuan. Kacific tidak membuat janji apa pun, atau memiliki kewajiban apa pun, untuk memantau aktivitas setiap Pengguna individu dan tidak memiliki kewajiban kepada pihak mana pun, termasuk Anda, atas setiap pelanggaran terhadap Kebijakan oleh Pengguna.

4.2 Kerja Sama dengan Penegakan Hukum. Kacific akan bekerja sama dengan lembaga-lembaga penegak hukum yang sesuai yang terlibat dalam penyelidikan tuntutan akan aktivitas ilegal atau kegiatan yang tidak pantas. Kacific berhak mengungkapkan Informasi Pelanggan dan Pengguna sejauh yang diizinkan oleh hukum. Dengan menggunakan dan menerima Layanan, Anda menyetujui pengungkapan yang kami lakukan kepada setiap lembaga penegak hukum, tanpa memerlukan panggilan pengadilan, mengenai identitas Anda sebagai penyedia layanan rekaman (termasuk informasi kontak), dan untuk setiap Pengguna dimana Kacific dihubungi oleh lembaga penegak hukum.

5. Penggunaan yang Dilarang

Penggunaan Layanan yang merupakan pelanggaran Kebijakan meliputi:

5.1 Kegiatan Ilegal. Layanan tidak boleh digunakan untuk aktivitas-aktivitas yang melanggar hukum dan dalam semua kasus harus digunakan sesuai dengan hukum yang berlaku. Penggunaan Layanan atau Jaringan Kacific untuk transmisi, distribusi, pengambilan, atau penyimpanan informasi, data, atau materi lainnya yang melanggar hukum atau peraturan yang berlaku (termasuk, jika berlaku, tarif atau perjanjian apa pun) adalah dilarang. Ini termasuk, namun tidak terbatas pada, penggunaan atau transmisi setiap data atau materi yang dilindungi oleh hak cipta, merek dagang, rahasia dagang, hak paten, atau hak kekayaan intelektual lainnya tanpa otorisasi yang sesuai dan transmisi segala materi yang merupakan ancaman pelanggaran, melanggar undang-undang pengawasan ekspor atau tindakan yang tidak senonoh, bersifat memfitnah, atau tindakan melanggar hukum lainnya.

5.2 Akses yang Tidak sah / Gangguan. Pengguna tidak boleh berupaya untuk mendapatkan akses yang tidak sah atau mencoba untuk mengganggu atau merusak fungsi, operasi atau keamanan normal dari setiap bagian Jaringan Kacific atau sistem satelit lainnya. Pengguna tidak boleh menggunakan Layanan untuk melakukan aktivitas apa pun yang dapat mengganggu kemampuan orang lain untuk mengakses atau menggunakan Layanan atau Internet. Pengguna tidak boleh menggunakan Layanan untuk memantau setiap data, informasi, atau komunikasi apa pun di setiap jaringan atau sistem tanpa izin. Pengguna tidak boleh berupaya untuk mendapatkan akses yang tidak sah ke akun pengguna atau kata sandi Pengguna lain. Dilarang keras menggunakan peralatan transmisi selain yang secara tegas disetujui oleh Kacific.

5.3 Email Komersial yang Tidak Diminta / Spamming / Mailbombing. Pengguna tidak boleh menggunakan Layanan untuk mengirimkan pesan email komersial yang tidak diminta atau dengan sengaja mengirim lampiran dengan ukuran yang terlalu besar ke satu penerima. Dilarang melakukan spamming atau “mailbombing”. Selain itu Pengguna tidak boleh menggunakan Layanan untuk mengumpulkan tanggapan dari pesan email massal yang tidak diminta. Kacific atas kebijakannya sendiri dapat mengandalkan informasi yang diperoleh dari organisasi anti-spamming sebagai bukti bahwa Pengguna adalah “operator spam” aktif untuk tujuan mengambil tindakan perbaikan berdasarkan Kebijakan ini.

5.4 Spoofing / Fraud. Pengguna dilarang menginjeksi data palsu ke Internet, misalnya dalam bentuk informasi routing yang buruk (termasuk namun tidak terbatas pada mengumumkan jaringan milik orang lain atau yang dimiliki oleh Perusahaan Internet untuk Nama dan Nomor-nomor Tertentu) atau informasi DNS yang salah. Pengguna tidak boleh berupaya mengirim pesan email atau mengirimkan komunikasi elektronik apapun dengan menggunakan nama atau alamat orang lain selain Pengguna untuk tujuan penipuan. Segala upaya untuk menyamar sebagai orang lain dengan mengubah informasi tentang alamat IP sumber atau dengan menggunakan tajuk palsu atau informasi pengenal lainnya dilarang. Segala upaya untuk secara curang menyembunyikan, memalsukan, atau memalsukan identitas Pengguna sehubungan dengan penggunaan Layanan adalah dilarang.

5.5 Keluhan Masuk. Kacific menerima keluhan langsung dari pengguna Internet dan pihak lain. Kacific tidak diwajibkan untuk menentukan keabsahan dari keluhan-keluhan yang sudah diterima, atau informasi yang sudah diperoleh dari organisasi anti-spam, namun akan memberi tahukan kepada Pelanggan tentang keluhan tersebut dan memberikan waktu yang wajar, tergantung sifat dari keluhan, agar Pelanggan dapat menyelesaikan keluhan tersebut dengan Pengguna sebelum mengambil tindakan berdasarkan Kebijakan.

 

5.6 Aktivitas Terlarang Lainnya. Kegiatan-kegiatan berikut juga merupakan pelanggaran Kebijakan dan dapat mengakibatkan penangguhan atau pengakhiran akses Pengguna ke Layanan.

5.6.1  Sengaja mengirimkan file yang berisi virus komputer atau data yang terkorupsi.

5.6.2 Mencoba mengakali atau mengubah proses atau prosedur untuk mengukur waktu, penggunaan bandwidth, atau metode-metode lain untuk mendokumentasikan penggunaan Layanan.

5.6.3 Mengiklankan, mentransmisikan, atau dengan cara menyediakan perangkat lunak, program, produk, atau Layanan yang dirancang untuk melanggar Kebijakan, termasuk memberikan fasilitasi sarana untuk mengirimkan email komersial yang tidak diminta.

5.6.4 Setiap aktivitas yang mengganggu, menurunkan, merugikan atau mengancam untuk membahayakan Jaringan atau Layanan Kacific.

5.6.5 Setiap pemakaian server email pihak lain untuk menyampaikan email tanpa izin tertulis dari pihak lain tersebut.

5.6.6 Setiap aktivitas yang tidak tepat atau penyalahgunaan Layanan (sebagaimana ditentukan oleh Kacific atas kebijakan kami sendiri), apakah tercantum secara eksplisit dalam Kebijakan atau tidak.

5.6.7 Setiap penggunaan Layanan untuk tujuan militer, kecuali penggunaan tersebut telah disetujui sebelumnya secara tertulis oleh Kacific.

5.6.8 Setiap penggunaan Layanan yang mencakup pemancaran gelombang radio dari Jepang dan perairan dan ruang udara teritorialnya.

6. Kebijakan Penggunaan yang Wajar Bagian 6.1, 6.2, 6.3, 6.4, dan 6.5 di bawah ini tidak berlaku untuk Pengguna layanan WIFI Komunitas. Semua Pengguna harus dapat mengakses layanan kami dan mendapatkan pengalaman terbaik. Untuk memastikan penyediaan layanan berkualitas tinggi, Kebijakan Penggunaan yang Wajar (“FUP”) berlaku untuk beberapa layanan Kacific di mana penggunaan oleh Pengguna dapat memengaruhi Pengguna lain. Kami telah mengembangkan FUP ini dengan mengacu pada rata-rata profil Pengguna dan memperkirakan penggunaan Layanan kami oleh Pengguna.

6.1. Bandwidth yang dialokasikan untuk Pengguna akan ditinjau sesuai kebutuhan, akan tetapi sewaktu-waktu, hanya ada sejumlah bandwidth tetap yang tersedia dalam jaringan Kacific. FUP ini bertujuan untuk memastikan bahwa penggunaan yang tidak wajar dari beberapa pengguna tidak membahayakan pengalaman penggunaan oleh sebagian besar Pengguna.

6.2. Kacific berhak mengubah (melalui kecepatan dan variabel lain) perilaku Pengguna yang sering menggunakan lebih banyak data secara signifikan dibandingkan mayoritas Pengguna lain dan / atau menggunakan layanan Internet mereka dengan cara yang secara negatif mempengaruhi pengalaman dari Pengguna lain. Jika Pengguna dinyatakan berada di antara 10% Pengguna terberat, dan penggunaan mereka berdampak negatif pada jaringan dan Pengguna yang lainnya, Kacific dapat mencoba untuk berkomunikasi dengan Penjual dan / atau Pengguna dan meminta Pengguna mengubah penggunaannya, menyarankan solusi yang lebih sesuai untuk semua pihak yang terlibat, atau dapat menggunakan haknya sebagaimana yang diatur dalam FUP ini.

6.3. Kacific dapat memberikan peringatan kepada Pelanggan dan / atau Pengguna untuk menangguhkan layanan Pengguna berdasarkan FUP ini, apabila menurut pendapat yang wajar dari Kacific penggunaan layanan kami oleh Pengguna berlebihan dan / atau tidak wajar karena secara material melebihi estimasi pola   penggunaan setiap bulan.

6.4. Apabila wajar dan praktis, Kacific akan memberikan pemberitahuan 7 hari sebelumnya kepada Pelanggan sebelum penangguhan, pembatasan, atau pengakhiran layanan Pengguna.

6.5. Jika, setelah kami meminta agar Pelanggan dan / atau Pengguna menghentikan atau mengubah penggunaan sesuai dengan kebijakan FUP kami, penggunaan Pengguna yang berlebihan atau tidak wajar masih terus berlangsung, maka kami dapat tanpa pemberitahuan lebih lanjut, mengenakan biaya ke akun Pengguna atas elemen kelebihan dan / atau penggunaan yang tidak wajar; menangguhkan, mengubah, atau membatasi penggunaan Anda atas layanan kami atau mencabut akses Anda ke layanan. Jika kami mengakhiri layanan Pengguna berdasarkan jangka waktu kontrak tetap maka berlaku biaya pengakhiran kontrak lebih awal.

Paket Kacific Gigstarter tunduk pada kebijakan prioritas sebagai berikut:

Paket Residential:

Paket ini memberikan kecepatan unduh maksimum sebesar 3Mbps dan kecepatan unggah maksimum sebesar 3Mbps. Paket ini tidak membatasi kecepatan maksimum ini tetapi memberikan dua tingkatan prioritas untuk mengakses sumber daya bandwidth.

Paket ini menyediakan 30Gbytes data unduhan prioritas pertama setiap bulan dan data unduhan prioritas kedua tanpa batas, tunduk pada kebijakan FUP ini. Paket tersebut memberikan data unggahan prioritas pertama setiap saat, sesuai dengan FUP ini.

Paket Residential:

Paket ini memberikan kecepatan unduh maksimum sebesar 15Mbps dan kecepatan unggah maksimum sebesar 10Mbps. Paket ini tidak membatasi kecepatan maksimum ini tetapi memberikan dua tingkatan prioritas untuk mengakses sumber daya bandwidth.

Paket ini menyediakan 35Gbytes data unduhan prioritas pertama setiap bulan dan data unduhan prioritas kedua tanpa batas, tunduk pada kebijakan FUP ini. Paket tersebut memberikan data unggahan prioritas pertama setiap saat, sesuai dengan FUP ini.

Paket Enterprise (penggunaan Internet hingga 4 pengguna):

Paket ini memberikan kecepatan unduh maksimum sebesar 30Mbps dan kecepatan unggah maksimum sebesar 10Mbps. Paket ini tidak membatasi kecepatan maksimum ini tetapi memberikan dua tingkatan prioritas untuk mengakses sumber daya bandwidth.

Paket ini menyediakan 50Gbytes data unduhan prioritas pertama setiap bulan dan data unduhan prioritas kedua tanpa batas, tunduk pada kebijakan FUP ini. Paket tersebut memberikan data unggahan prioritas pertama setiap saat, sesuai dengan FUP ini.

Paket Enterprise (penggunaan Internet hingga 5-6 pengguna):

Paket ini memberikan kecepatan unduh maksimum sebesar 40Mbps dan kecepatan unggah maksimum sebesar 10Mbps. Paket ini tidak membatasi kecepatan maksimum yang mungkin ada namun menyediakan dua tingkatan prioritas akses ke sumber daya bandwidth.

Paket ini menyediakan 85Gbytes data unduhan prioritas pertama setiap bulan dan data unduhan prioritas kedua tanpa batas, tunduk pada kebijakan FUP ini. Paket tersebut memberikan data unggahan prioritas pertama setiap saat, sesuai dengan FUP ini.

Paket Enterprise (penggunaan Internet hingga 7 pengguna):

Paket ini memberikan kecepatan unduh maksimum sebesar 50Mbps dan kecepatan unggah maksimum sebesar 10Mbps. Paket ini tidak membatasi kecepatan maksimum yang mungkin ada namun menyediakan dua tingkatan prioritas akses ke sumber daya bandwidth.

Paket ini menyediakan 185Gbytes data unduhan prioritas pertama setiap bulan dan data unduhan prioritas kedua tanpa batas, tunduk pada kebijakan FUP ini. Paket tersebut memberikan data unggahan prioritas pertama setiap saat, sesuai dengan FUP ini.

Paket Enterprise (penggunaan Internet hingga 10 pengguna):

Paket ini memberikan kecepatan unduh maksimum sebesar 60Mbps dan kecepatan unggah maksimum sebesar 20Mbps. Paket ini tidak membatasi kecepatan maksimum yang mungkin ada namun menyediakan dua tingkatan prioritas akses ke sumber daya bandwidth.

Paket ini menyediakan 295Gbytes data unduhan prioritas pertama setiap bulan dan data unduhan prioritas kedua tanpa batas, tunduk pada kebijakan FUP ini. Paket tersebut memberikan data unggahan prioritas pertama setiap saat, sesuai dengan FUP ini.

Paket Enterprise (penggunaan Internet hingga 25 pengguna):

Paket ini memberikan kecepatan unduh maksimum sebesar 70Mbps dan kecepatan unggah maksimum sebesar 20Mbps. Paket ini tidak membatasi kecepatan maksimum yang mungkin ada namun menyediakan dua tingkatan prioritas akses ke sumber daya bandwidth.

Paket ini menyediakan 735Gbytes data unduhan prioritas pertama setiap bulan dan data unduhan prioritas kedua tanpa batas, tunduk pada kebijakan FUP ini. Paket tersebut memberikan data unggahan prioritas pertama setiap saat, sesuai dengan FUP ini.

Paket Enterprise (penggunaan Internet hingga 60 pengguna):

Paket ini memberikan kecepatan unduh maksimum sebesar 100Mbps dan kecepatan unggah maksimum sebesar 20Mbps. Paket ini tidak membatasi kecepatan maksimum yang mungkin ada namun menyediakan dua tingkatan prioritas akses ke sumber daya bandwidth.

Paket ini menyediakan 1,425Gbytes data unduhan prioritas pertama setiap bulan dan data unduhan prioritas kedua tanpa batas, tunduk pada kebijakan FUP ini. Paket tersebut memberikan data unggahan prioritas pertama setiap saat, sesuai dengan FUP ini.

Paket Enterprise (penggunaan Internet hingga 60 pengguna):

Paket ini memberikan kecepatan unduh maksimum sebesar 150Mbps dan kecepatan unggah maksimum sebesar 30Mbps. Paket ini tidak membatasi kecepatan maksimum yang mungkin ada namun menyediakan dua tingkatan prioritas akses ke sumber daya bandwidth.

Paket ini menyediakan 3,188Gbytes data unduhan prioritas pertama setiap bulan dan data unduhan prioritas kedua tanpa batas, tunduk pada kebijakan FUP ini. Paket tersebut memberikan data unggahan prioritas pertama setiap saat, sesuai dengan FUP ini.

Kebijakan prioritas berikut hanya berlaku untuk Pelanggan/Pengguna yang layanannya diaktifkan sebelum tanggal berikut:

Paket ini memberikan kecepatan unduh maksimum sebesar 20Mbps dan kecepatan unggah maksimum sebesar 5Mbps. Paket ini tidak membatasi kecepatan maksimum yang mungkin ada namun menyediakan dua tingkatan prioritas akses ke sumber daya bandwidth.

Paket ini menyediakan 49Gbytes data unduhan prioritas pertama setiap bulan dan data unduhan prioritas kedua tanpa batas, tunduk pada kebijakan FUP ini. Paket tersebut memberikan data unggahan prioritas pertama setiap saat, sesuai dengan FUP ini.

Paket Enterprise (penggunaan Internet hingga 4 pengguna):

Paket ini memberikan kecepatan unduh maksimum sebesar 35Mbps dan kecepatan unggah maksimum sebesar 5Mbps. Paket ini tidak membatasi kecepatan maksimum yang mungkin ada namun menyediakan dua tingkatan prioritas akses ke sumber daya bandwidth.

Paket ini menyediakan 70Gbytes data unduhan prioritas pertama setiap bulan dan data unduhan prioritas kedua tanpa batas, tunduk pada kebijakan FUP ini. Paket tersebut memberikan data unggahan prioritas pertama setiap saat, sesuai dengan FUP ini.

6.6. Reseller dan Pengguna mengakui bahwa Kacific tidak dan tidak dapat dengan cara apapun mengawasi, mengedit atau mengendalikan konten dan bentuk informasi atau data apa pun yang diakses melalui Internet, dan Kacific tidak akan bertanggung jawab dengan cara apa pun atas konten atau informasi yang diakses melalui Layanan Kacific. Selain itu, Kacific menyangkal semua atau setiap tanggung jawab atau kewajiban apa pun atas setiap materi yang ada di Internet yang menurut Anda menyinggung, menjengkelkan, memfitnah, dan secara pribadi menyinggung dan dengan cara apa pun tidak sesuai untuk anak di bawah umur.

6.7. Beberapa situs internet mungkin telah menanamkan kemampuan untuk memprogram PC, perangkat WIFi, tablet atau ponsel Anda, dll. Tanpa sepengetahuan atau arahan Pengguna. Pengguna bertanggung jawab atas setiap biaya yang timbul dari tindakan tersebut oleh pihak ketiga dan Kacific tidak bertanggung jawab atas biaya dan / atau kerusakan apapun yang mungkin ditimbulkan oleh Pengguna akhir dengan menggunakan Internet.

6.8. Pengguna tidak diizinkan untuk mengoperasikan server dari Layanan dan Pengguna tidak diizinkan untuk menjual Layanan ini tanpa persetujuan tertulis dari Kacific.

6.9. Pengguna tidak diizinkan untuk mengirimkan spam atau surat massal dengan menggunakan Layanan dan Kacific berhak untuk membebankan biaya apapun yang diperlukan untuk memperbaiki akibat dari aktivitas tersebut oleh Pengguna.

6.10. Kacific berhak mengelola jaringan untuk meningkatkan kinerja dan pengalaman pelanggan secara keseluruhan. Secara khusus, Kacific dapat bertindak sedemikian rupa sehingga penggunaan layanan populer seperti perambah web standar dan email dan bahwa layanan-layanan ini tidak terpengaruh oleh aplikasi lain seperti peer to peer atau file sharing.

6.11. Penggunaan Pengguna atas Layanan kami tunduk pada prioritas lalu lintas oleh Kacific, di mana alokasi sumber daya bandwidth diperlukan untuk meminimalkan kebuntuan.

6.12. Kacific menggunakan konfigurasi Quality of Service (OoS) dalam jaringannya dan mutlak berdasarkan kebijakannya sendiri untuk memprioritaskan jenis lalu lintas internet tertentu di atas yang lain untuk meningkatkan pengalaman Pengguna secara keseluruhan.

Kecepatan maksimum ini tidak dijamin dan kemungkinan untuk memperoleh kecepatan tersebut tergantung pada tingkat prioritas setiap Pengguna dan faktor pemuatan lalu lintas instan.

6.13. Kacific berhak untuk setiap saat dan atas mutlak berdasarkan kebijakannya sendiri dan tanpa pemberitahuan sebelumnya, mengubah, memodifikasi, mengedit, mengganti atau mencabut setiap atau semua FUP ini.

6.14. FUP ini tidak menggantikan setiap syarat, ketentuan, atau kewajiban apa pun berdasarkan perjanjian atau kontrak reseller. Dan jika terdapat ketidaksesuaian atau kebingungan maka perjanjian atau kontrak reseller akan berlaku menggantikan FUP ini.

7. Keluhan dan Informasi Kontak

Semua keluhan atau pemberitahuan mengenai penggunaan yang dilarang atau penyalahgunaan lainnya dari Jaringan Kacific, termasuk pelanggaran Kebijakan, harus dikirimkan kepada Kacific melalui email di complain@kacific.com. Harap untuk menyertakan semua informasi yang berlaku yang akan membantu Kacific dalam menyelidiki keluhan, termasuk semua tajuk dari pesan yang diteruskan.
